X5 Core, LLC (“X5 Core”) provides a mobile messaging program to keep you informed about our services, updates, and promotions. We value your privacy and want to ensure you fully understand how our SMS (text messaging) program works. These SMS Consent & A2P (Application-to-Person) Terms outline the terms and conditions for receiving text messages from us, in compliance with CTIA (Cellular Telecommunications Industry Association) guidelines and the Telephone Consumer Protection Act (TCPA).

By opting in to our text messaging service, you agree to the following:
Program Description: When you opt in, you consent to receive recurring text messages (SMS and MMS) from X5 Core on your mobile device. Messages may be sent via an automated dialing system. These messages will include things like: updates on our digital marketing and CRM services, special promotions or offers, account notifications, appointment or meeting reminders, and customer service communications related to your interactions with X5 Core. Examples: We might text you to confirm a consultation booking, to provide a status update on a project, or to share a limited-time marketing tip or offer. Consent to receive these messages is not a condition of purchasing any goods or services from us. Whether you purchase from X5 Core will not affect your ability to receive messages – and vice versa, you are not required to opt in to make a purchase.
Message Frequency: The number of messages you receive will vary. Message frequency may vary based on your interaction with us and what you have signed up for. Generally, you can expect approximately [5-8 messages per month] (this can include both marketing and transactional texts). During certain periods (for example, if you’re actively engaged in a project or if you signed up for daily tips), frequency might be higher, but we strive not to overload you. Any promotional campaign will specify its frequency (e.g., “Up to 4 messages per month”). If at any time you feel you are receiving more messages than you expected, please contact us or simply opt out (instructions below).
Opt-In Consent: You can join our SMS list by filling out a web form or paper form that includes a mobile number field and a checkbox or other mechanism where you provide express consent. For example, a form might say: “Yes, I agree to receive SMS updates from X5 Core” next to a checkbox. Alternatively, we might ask you to text a keyword (like “X5START”) to a designated number to initiate opt-in. In all cases, we obtain your prior express written consent as required by TCPA before sending marketing texts. If you are opting in via a web form, by clicking the “Submit” or similar button, you agree that you are electronically signing your consent to receive texts. We will send a confirmation text to welcome you to the program and to confirm your consent details.
Opt-Out (How to Unsubscribe): You can cancel the SMS service at any time. To stop receiving texts, simply text “STOP” to the number you received messages from (or reply “STOP” to any of our messages). After you send the SMS message “STOP” to us, we will send you a one-time opt-out confirmation text to let you know you have been unsubscribed. After this confirmation, you will no longer receive SMS messages from X5 Core unless you re-subscribe. If you have multiple programs or shortcodes, the opt-out might apply to the specific program you replied to; our confirmation will clarify if you’ve opted out of all X5 Core texts or a particular subset. Note: If you opt out and later want to rejoin, you may opt in again by the original method (for example, texting the keyword again or signing up via web form), and we will resume sending SMS messages to you.
Help and Support: If you are experiencing issues with the messaging program or have any questions, you can reply with the keyword “HELP” at any time for assistance. When you text “HELP”, we will respond with instructions on how to manage your subscriptions and how to contact our support. Cost and Carriers: Message and data rates may apply to any SMS or MMS we send, or that you send to us. This means that you may incur charges from your wireless carrier for messages and data transmitted. For example, if you do not have an unlimited texting plan, each text we send could count towards your plan limits or incur a fee. The same applies to any multimedia messages (MMS) we might send (though currently we anticipate most messages will be text-only unless noted). We do not impose any additional fees – any charges would come from your carrier according to your plan. If you have questions about your text or data plan and what it covers, it’s best to contact your wireless provider. By opting into our SMS program, you acknowledge that you are responsible for any messaging or data charges you incur.
Our SMS program is compatible with most major U.S. mobile carriers including (but not limited to) AT&T, Verizon, T-Mobile, Sprint, US Cellular, and others. However, availability of the service is subject to your mobile carrier’s coverage. X5 Core is not liable for any delays or message failures which result from cellular network issues.
Participating Carriers & Liability: Delivery of SMS messages is subject to effective transmission by your mobile carrier. While we strive for timely delivery, carriers are not liable for delayed or undelivered messages, and accordingly, X5 Core cannot guarantee that texts will arrive at a particular time. Factors like carrier outages or network issues may cause delays. We ask for your understanding in such events. Supported carriers for our program typically include all major US carriers as listed above, and the list may update. Regardless, your carrier and X5 Core are not responsible for technical difficulties or texts that don’t arrive due to factors beyond our control (like you being out of range or having a full inbox).
Privacy: Your privacy is important to us. We will not share or sell your mobile number or any personal information collected through our SMS program to third parties for their marketing purposes. Text message originator opt-in data and consent data will not be shared with any third party except as needed to send you messages through our SMS service providers (aggregators/carriers). All information you provide to X5 Core through the SMS program (such as your phone number and any other personal details) is governed by our Privacy Policy. We encourage you to review our Privacy Policy (available on our website) for information on how we collect, use, and protect your personal data. In short, we use your phone number solely to send you the messages you agreed to receive, and for internal analysis to improve our services. We may also use it to contact you directly if needed for service issues. We take measures to secure your data and will only retain it as long as necessary for the purposes of the messaging program or as required by law.
Content of Messages: The text messages we send may be in SMS or MMS format. SMS are standard text-only messages up to 160 characters. MMS can include images, videos, or longer text. By opting in, you agree to receive either format as needed. Typically, our messages will be informational or promotional in nature as described, and not overly lengthy. We will not send content that is inappropriate or prohibited: we adhere to carrier content guidelines (no hate speech, no profanity, no illegal offers, etc.). If you ever receive a message from us that seems out of character or possibly fraudulent, contact us directly or text HELP. It’s possible (though rare) that numbers can be spoofed; we want to ensure you only get authentic X5 Core communications.
No Warranty & Liability: X5 Core’s mobile messaging service is provided on an “as-is” basis. We are not responsible for any delays in receiving messages, as delivery is subject to effective transmission from your network operator. We make no warranty regarding the availability or reliability of this service. To the fullest extent allowed by law, we will not be liable for any direct or indirect damages related to your use or receipt of text messages (for example, if a message is delayed or if there is a formatting error). However, nothing in these terms is intended to limit any rights you may have under law or any liability that cannot be lawfully limited.
Participant Requirements: By opting into our SMS program, you certify that you are 18 years of age or older, or if you are under 18, that you have the consent of a parent or legal guardian to receive messages from us. Our program is intended for U.S. residents. If you are outside the U.S., message availability may be limited or not available. Additionally, you confirm that you are the owner or authorized user of the mobile device and number that you provided for enrollment. You should not subscribe with a number that is not yours or that you do not have permission to use. If you change or deactivate your mobile number, you agree to promptly notify us to prevent messages from being sent to whoever might acquire your old number.
Changes to Terms: We may revise these SMS terms from time to time, as required to comply with law or to reflect changes in our program. If we make material changes, we will provide notice (for example, by texting you about the change or linking to the updated terms). By continuing to receive messages after such notice, you acknowledge and accept the changes. If you do not agree, you should unsubscribe from the service.

Non-Marketing Communications: Note that if you provide us your number in the context of a specific transaction or service (for instance, you gave your number when signing an agreement or scheduling an appointment), we might send you necessary non-marketing texts even if you haven’t subscribed to general marketing messages. These could include appointment reminders, important account notices, or verification codes. Those transactional texts are separate from the marketing program and are governed by our general Terms of Use and Privacy Policy, but the opt-out instructions still apply – you can reply STOP to any of those to opt out of that communication channel as well (though doing so might mean you won’t receive critical notices, which is at your own risk).
